PHOTOGRAPHY/VIDEOGRAPHY LOCATION(S)

A deposit is required of at least 20% in the amount of (20% of INVESTMENT) to secure your date. This is due within 2 weeks of booking your date with Wanda Diehl Photography / WD Photography. Your date is temporarily booked until the deposit is received. After two weeks, Wanda Diehl Photography / WD Photography reserves the right to open your date to potential clients. The 20% deposit is non-refundable and due to book your date. Any additional payments over 20% are refundable should you need to cancel your date, based on the discretion of the photographer only. Less than one month of cancellation from the date of your wedding or event, grants no refund or based on the total discretion of the photographer. Upon booking today, I am paying a deposit in the amount of (AMOUNT YOU ARE PAYING AT BOOKING) down on my package. My balance is now (REMAINING BALANCE AFTER DEPOSIT) and I am aware that the balance must be paid in full no less than 2 weeks prior to the wedding date unless otherwise agreed upon between the CLIENT and the photographer. Any additional purchases will be paid for at the time of ordering, unless added in addition to the package at the time of booking. In this case, please add to package notes/additions and update your total. Please remember that if your package includes a complimentary engagement session, this is free of charge to you and included in your package. Choosing whether or not to take advantage of the engagement session is up to the client, as well as the photographer’s discretion. If it is raining (or otherwise unsafe outside) at the time of your session, you will be asked to reschedule as the COMPANY will not jeopardize the safety of the equipment, photographer or safety of the CLIENT. You may also choose to add credits towards your package and not take the engagement session.

ADDITIONAL TRAVEL COSTS APPLIED TO MY TOTAL AMOUNT: (AMOUNT) – At this time, I service ALL of PA at no additional travel fee. This is subject to change at any time. Any change will not affect current bookings. Depending on location outside of PA, depends on travel fee, if applied.

PAYMENT TERMS: DEPOSIT PAID (CASH) (CHECK)(CC/PAYPAL)(OTHER) – Balance payments/payoff: you may pay your balance in payments that best suits your needs. Checks can be mailed to the address above. Returned checks are subject to a $40 fee. Cash payments will be received with a receipt, in person only. Credit card payments can be processed through my website or an invoice can be requested. Reminder, the complete balance must be received 2 weeks prior to the wedding date.

(YOUR COMPLETE PACKAGE INFORMATION)

This Agreement is made effective for all purposes in all respects as of (CURRENT DATE) by and between Wanda Diehl Photography / WD Photography, hereinafter referred to as “THE COMPANY” and (CLIENTS NAME(S) hereinafter referred to as “THE CLIENT” relating to the EVENT(S) detailed above, hereinafter referred to as “THE EVENT(S)”.

ENTIRE AGREEMENT: This Agreement contains the entire understanding between the COMPANY and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this Agreement is to do so in writing, signed by all parties. Email is also accepted as confirmation of changes. In the event that any party of this Agreement is found to be invalid or unenforceable, the remained of this Agreement shall remain valid and enforceable. Any Agreement to waive one or more provisions of this agreement of any failure by one or both parties to enforce a provision of this agreement shall not constitute a waiver of any portion of this Agreement.

RESERVATION: A signed contract and booking fee are required to reserve the date(s) and time(s) of the EVENT(S). If the EVENT(S) are rescheduled, postponed or cancelled; or if there is a breach of contract by the CLIENT, the 20% booking deposit is non-refundable and shall be liquidated damages to the COMPANY. The CLIENT shall also be held responsible for payment for any of the COMPANY’s materials charges incurred up to the time of cancellation. This includes the complimentary engagement session, if this was included in the package and used, before the time of cancellation. The CLIENT is responsible for paying the remaining balance of $250.00, the cost of the engagement session in question.

The deposit of (20% AMOUNT) is non-refundable, even if the date is changed or the EVENT(S) cancelled for any reason including Acts of God, fire, strike, and/or extreme weather. The photographer will do their best to accommodate any changes of dates and times. The booking deposit is applied towards the contracted EVENT(S) photography and/or videography package totaling (AMOUNT OF INVESTMENT). The balance of (REMAINING AMOUNT AFTER DEPOSIT) is to be paid in full, two weeks prior to the day of the EVENT(S). Photography/Videography will not commence before the invoice is paid in full. Approximately two weeks prior to the wedding, CLIENTS must finalize with the photographer a schedule of hours, locations, and if desired an Event Guide.

EVENT SCHEDULE: The CLIENT agrees to confirm the schedule one to two weeks prior to the EVENT(S). Any notification of changes in schedule or location must be made in a timely manner and confirmation of receipt must be obtained from the COMPANY by the CLIENT.

SAFETY: The COMPANY reserves the right to terminate coverage and leave the location(s) of the EVENT(S) if the photographer(s) from the COMPANY experience inappropriate, threatening, hostile or offensive behavior from person(s) at the EVENT(S); or if the event that the safety of the photographer(s) from the COMPANY is in question. This includes terminating outdoor EVENT(S) in the result of a storm, rain or other hazardous weather that would result in destruction of COMPANY property.

EXPENSES INCURRED: When applicable, the CLIENT is responsible for all travel, accommodation, meal and transport costs unless provided by the CLIENT. TRAVEL EXPENSES: All travel expenses are based on the distance between the EVENT location(s) and the COMPANY base. For all EVENT(S), the first 4 hours of mapped travel time is included. EVENT(S) outside of 4 hour time is charged at $50-$150 unless otherwise agreed, based on location. EVENT(S) that would include alternative travel or hotel accommodations, will be quoted a travel fee based on the discretion of the photographer.

RESPONSIBILITIES: The COMPANY is not responsible for compromised coverage due to causes beyond the control of the COMPANY including but not limited to obtrusive guests, lateness of the CLIENT or guests, weather conditions, schedule complications, incorrect addresses provided to the COMPANY, rendering of decorations, or restrictions at the location(s). The COMPANY is not responsible for backgrounds and lighting conditions which may negatively impact or restrict the photo or video coverage. The COMPANY is not held liable for missed coverage of any part of the EVENT(S). The COMPANY will not be held accountable for failure to deliver images to any individuals or any objects at the EVENT(S).

VENUE AND LOCATION LIMITATIONS: The COMPANY is limited by the rules and guidelines of the location(s) and site management. The CLIENT agrees to accept the technical results of their imposition on the COMPANY. Negotiation with the officials for moderation of guidelines is the CLIENT’S responsibility; the COMPANY will offer technical recommendation(s) only.

PERMITS: The CLIENT is responsible for acquiring any and all permits and necessary permission for all location(s) the COMPANY will be performing services.

FILM & COPYRIGHT: The photographs and videos produced by the COMPANY are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without the COMPANY’S explicitly written permission. If the CLIENT has purchased an “IMAGE DVD or USB” from the COMPANY, upon final payment the CLIENT, limited copyright ownership of the resulting images will be transferred to the CLIENT. If the CLIENT has purchased an “IMAGE DVD or USB” from the COMPANY, the COMPANY grants the CLIENT permission to share the images on social networking websites, with family and friends, through email, and on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the COMPANY. The CLIENT must obtain written permission from the COMPANY prior to publishing or selling the photographs.

MODEL RELEASE: The CLIENT hereby assigns the COMPANY the irrevocable and unrestricted right to use and publish photographs and videos of the CLIENT or in which the CLIENT may be included, for editorial trade, advertising, educational, and any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same without restriction. The CLIENT releases all claim to profits that may arise from use of images.

LIMIT OF LIABILITY: In the unlikely event that the assigned photographer(s) from the COMPANY is unable to perform to the guidelines of this contract due to an injury, illness, Act of God, act of terrorism, or other cause beyond the control of the COMPANY, the COMPANY will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments, including the deposit for EVENT(S).

In the unlikely event that digital files have been lost, stolen or destroyed for any reason beyond the COMPANY’S control, but not limited to camera, hard-drive, or equipment malfunction, the COMPANY liability is to return all payments for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The COMPANY is not liable for the loss of images beyond the lesser of the final delivery of the products included in the package or one year.

EXCLUSIVE PHOTOGRAPHER/VIDEOGRAPHER: The COMPANY shall be the exclusive photographer or videographer retained by the CLIENT for the purpose of photographing or videographing the EVENT(S) unless noted that you have intentions on hiring multiple photographers/videographers prior to the EVENT(S). Due to the limited time restrictions to the EVENT(S), family and friends of the CLIENT shall be permitted to photograph the EVENT(S) as long as they shall not interfere with the photographer’s duties.

CAPTURE & DELIVERY: The COMPANY is not liable to deliver every image or minute of video taken at the EVENT. The determination of images/video delivered to the CLIENT is left to the discretion of the COMPANY. 99% of the time your “IMAGES DVD or USB” will contain all images.

POST PRODUCTION & EDITING: The final post production and editing styles, effects and overall look of the images and/or video are left to the discretion of the COMPANY, unless the CLIENT and COMPANY have agreed on a specific look or style.

DRESS CODE: The COMPANY’S assigned photographer will dress business casual (i.e black pants and dress shirt) unless otherwise agreed between both the CLIENT and COMPANY. If your EVENT(S) are black-tie or jeans-casual, please let the COMPANY know that different attire is suitable or requested. Comfortable footwear will be worn at the discretion of the assigned photographer, including the ability to wear acceptable sneakers. If the CLIENT has a color-scheme and would like the COMPANY’S assigned photographer to follow suit, please let the COMPANY know in advance when finalizing the EVENT(S) with the COMPANY.

PAYMENT SCHEDULE: The aforementioned 20% non-refundable deposit is due at the time of signing this Agreement or no more than 2 weeks from signing this Agreement. The remaining balance is payable in full no less than two weeks prior to the day of the EVENT(S). In the event the CLIENT fails to remit payment as specified, the COMPANY shall have the right to immediately terminate the Agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S). Returned checks will be assessed $40 non-sufficient funds fee.

PRICING: Services or merchandise not included in the initial contract will be sold at the current price when the order is placed. All prices are subject to change at any time without notice. Credit vouchers have no cash value and may only be applied toward merchandise purchased from the COMPANY.

RESCHEDULING POLICY: The CLIENT must notify the COMPANY if they are rescheduling any booked EVENT(S). A 20% of package total or $100, lesser of the two may be charged to reschedule. Rescheduling fee is based on the discretion of the COMPANY. If your new date is already booked with the COMPANY, you shall be entitled to receive any additional monies paid over the booking deposit of 20% or accept a replacement photographer if one is available and keep your current contract valid.

PROJECTED DELIVERY SCHEDULE(S):
3-7 Days after the EVENT(S): Online gallery is online and link is provided to the CLIENT for viewing and ordering any prints and products within their package. Any videos are online and shipped.
7-21 Days after the EVENT(S): Hi-Res files on DVD or USB, online gallery, and prints, as long as the requested images for your print sizes are received by the COMPANY from the CLIENT in a timely manner.
1-4 Weeks after the EVENT(S): Wedding albums, proof books, and canvas prints if included in your package or add ons.

These timelines are based off of prior timelines, therefore it truly depends on the time between the CLIENT receiving their online galleries and the time that the COMPANY receives their image requests for all products and prints to be ready.

This contract Agreement incorporates the entire understanding of the parties involved. And modification of this contract Agreement must be in writing and signed by both parties. To confirm your booking and acknowledge acceptance of this contract, please sign, date and return with the booking deposit, if you haven’t done so already, to the COMPANY. It is recommended you print or save a copy for your records. Booking through the website is acceptance of this Agreement.
